Evolation Learning has an open admissions policy seeking to provide equitable access to quality training.
This policy is in place to ensure all clients of Evolation Learning are provided with information and processes for admission to Training Programs offered by Evolation Learning, the training they will receive, assessment and support services to be provided and their rights and obligations in accordance with Standard 5 Clauses 5.1, 5.2, 5.3, 5.4
This policy and procedure covers all staff involved in the admissions procedure for clients wishing to study with Evolation Learning.
Applicants are provided with details of training programs by mailing out of brochures or by accessing information on the website. These include detailed information about training programs available, RPL procedures and costs, recognition of qualifications and statements of attainment issued by other RTOs, training program dates, locations, times, cost and how to enrol.
Applicants are advised to book early because places may be limited. Enrolments are made in writing, by phone, or online.
On application, and again when they confirm their enrolment, Evolation Learning will discuss client needs and provide information to assist them in choosing the training program and provider most appropriate to their needs and situation. This will sometimes involve referring them to other providers.
Enrolments are accepted in order of confirmation and immediately entered on the class list. If a place is not available, applicants are placed on a waiting list and are informed of the next class available.
If a cancellation is received Evolation Learning will notify those on the waiting list in order of listing to offer them a place. If there are sufficient people on the waiting list Evolation Learning will endeavour to organise another class.
When individuals or small groups cannot attend a class, Evolation Learning may offer to conduct individual tutorial training sessions to meet their needs upon special negotiation taking place between Evolation Learning and the participant. Fees for this vary as there are many factors that need to be taken into consideration, for example, numbers, location, units of competency and equipment.
Where there are any changes to agreed services, Evolation Learning the RTO advises the learner as soon as practicable, including any new third party arrangements or a change in ownership or changes to existing third party arrangements.
STUDENT FEES AND REFUNDS
Evolation Learning has a policy of providing a refund of fees to students and to safeguarding those fees until a request and appropriate assessment has been made of their full or partial refund.
Where an applicant has paid the fees for a training program and wishes to cancel prior to the commencement of the training program, a full refund of the fees will be made minus a $200 enrolment fee.
Where a cancellation is made after the commencement of the training program for a reason beyond the control of the student, they will be offered the opportunity of completing the training program at the next available opportunity. If this is not possible, a pro-rata refund may be made. This refund will be calculated working out the total payment made by the student, minus the enrolment fee and fees for any services and materials provided. Evolation Learning will provide a breakdown of total fees as a sign of being transparent about the refund.
Change of mind or change of work circumstances (such as leaving the industry) is not a valid reason for a refund. In the event of a change of mind, or change in work circumstances, consideration of a refund will be given. In these circumstances, students may request a refund. If not exceeding 50% of the total value of the course. This represents the maximum potential refund however it will be calculated based on a pro-rata basis of materials, time and services provided to date.
All refunds are calculated based on the time of enrolment, access to materials, assessments completed and provision of student support (whether or not the student has accessed or utilised this support).
When situations arise where a refund is requested, students will be offered an opportunity to transfer into another course of study which is offered by Evolation Learning.
When a training program is cancelled by Evolation Learning and alternative training programs do not suit the applicant a full refund of fees will be made within fourteen (14) days of receipt of an application for refund. Evolation Learning may provide a full or partial refund of fees in exceptional circumstances or through illness or injury preventing the Student from completing the unit/module.
In exceptional cases of financial hardship or other extenuating circumstances, the student may make an application for a full or partial refund and forward this in writing to Evolation Learning.
The purpose of this procedure is to ensure student is refunded fees where appropriate in accordance with Standard 5 Clause 5.3
This procedure applies to any staff involved in the processing of refunds by Evolation Learning.
1. Applying for refund
Any student applying for a refund must do so in writing to the CEO of Evolation Learning stating the reasons for requesting a refund. Students in doing so, understand that they may not be entitled to a full refund; the amount of the refund will be determined by the CEO of Evolation Learning.
When the accredited training program, qualifications training program or any other training program has been cancelled by Evolation Learning, Evolation Learning will refund the fees paid by the student in full within fourteen (14) days of the cancellation.
3. Assessment of refund
Upon receipt of the application for refund of fees in writing, the appropriate staff member of Evolation Learning will check to ascertain whether the student has attended classes, or been issued with any relevant training materials or resources. The refund payment will be made within fourteen (14) days of receipt of application for refund. The student will be provided with a breakdown of expenses if a full refund is not provided.
4. Exceptional circumstances
In exceptional cases of financial hardship or other extenuating circumstances, the student may make an application for a full or partial refund and forward this in writing to the CEO of Evolation Learning. Students must understand that it is not guaranteed that a full refund will be issued.
The CEO of Evolation Learning will then determine whether the application is approved, and if approved, will make sure the student is removed from the class roll, and the full or part amount of refund is returned to the student prior to the commencement of the training program within fourteen (14) days of receipt of an application for refund.
Collection of Fees
Evolation Learning collects student fees in advance and will comply with standard 7.3 in respect to the fees charged. This information will be explained in our website or course brochures or fact sheets.
Evolation Learning will not accept payment of more than $1500 from each individual student prior to the commencement of the course. Following course commencement, additional fees in advance from the student, will be required to be paid, which is attributable to tuition or other services yet to be delivered to the student, but only such that at any given time, the total amount paid in advance must not exceed $1500.
Where a student is on a payment plan and defaults on any payment; their enrolment may be cancelled and no refund issued. Where a student is on a fortnightly payment plan defaults for an amount above 10% of the total course fee, or any other payment plan which is more than 21 days overdue; Evolation Learning reserves the right to cancel the student’s enrolment and no refund will be issued. Students will be advised in writing when this occurs. Evolation Learning reserves the right to collect any outstanding fees.
The procedure for an initial inquiry by a potential student is as follows:
- An enrolment form is forwarded to the potential participant, either by mail, online or by email.
- Promotional advertising brochure or fact sheet and material containing all training program information and/or Student/Student Handbook is forwarded to potential participants or provided online. This material will include information on the items listed in paragraph 2 above.
- Participants are advised they can pay by cheque/credit card/debit card on the day they enrol in the training program, by mail, online, email or in person
- A receipt is then forwarded to the participant.
RECOGNITION OF PRIOR LEARNING (RPL)
Evolation Learning will recognise prior learning and qualifications of a client and assess their current skills and knowledge against the competency in which the student is enrolled with the aim of reducing the training time and the duplication of training/assessment.
The purpose of this policy and procedure is to provide all applicants with a consistent, valid, fair, reliable, flexible and efficient method of seeking recognition of prior learning regardless of how or where the knowledge and skills have been gained in accordance with Standard 1. Clause 1.12
This policy and procedures cover all staff involved in the application made by a client in seeking recognition in a vocational education and training program offered by Evolation Learning.
An applicant applying for recognition of prior learning in any of the units of competency offered by Evolation Learning will be given access to the unit of competency so that they may determine their eligibility to apply for the recognition they seek.
If the applicant wishes to continue, they will be requested to complete an application form for RPL.
The applicant will be advised of the type of evidence that is required for them to be assessed by a person who has the qualifications to assess the application. This evidence may include former work history, job descriptions, examples of workplace activities and practices, documentation, certificates or evidence of attendance at seminars etc.
If the applicant wishes to continue with their application, they will be requested to enrol in the unit of competency in which they are seeking recognition and pay the relevant fee. Arrange an interview with a trainer/assessor from Evolation Learning who has been appointed by Evolation Learning in order to discuss their application and its potential outcome. At the interview with the applicant, the trainer/assessor will make a preliminary assessment of the type of evidence supplied by the applicant, and if further evidence or further assessment is required, the applicant will be advised. This evidence may include knowledge questions relating to the unit of competency and or a Practical Skills Assessment.
All applicants must then submit their fully completed application form and evidence required that must be certified by a Justice of the Peace or a Commissioner for Affidavits.
Upon receipt of the completed application form and accompanying evidence, the trainer/assessor appointed by Evolation Learning will make an assessment on the outcome of the application.
The outcome of the assessment will be documented on the application form and advised to the client in writing.
The applicant will have the right to appeal. This policy is documented in The Student Handbook and in the Policy and Procedure: Complaints and Appeals.
Upon successful application, by the client, a result will be recorded against the applicant’s name and a Statement of Attainment will be issued. For all applicants enrolling in full qualifications or skillsets, the RPL result will be recorded in their Training Plan.
LANGUAGE, LITERACY & NUMERACY
Evolation Learning is committed to providing guidance or support to those students who have any identified issues in relation to language, literacy or numeracy support in accordance with Standard 1 Clause 1.7
To provide guidelines for the identification of any student guidance or support required for any student in Language, Literacy and Numeracy support.
This procedure is for training and assessment staff working with students undertaking accredited training with Evolation Learning.
Evolation Learning is particularly aware of the requirement to evaluate the student in their language, literacy and numeracy (LLN) skills.
At enrolment, a non-intrusive check on the student’s LLN skills is carried out. Action is taken to ensure whatever identifiable shortfall the student may have is addressed during his or her training. This assessment will be conducted by a person with the relevant vocational competencies and qualifications.
The action and adaptation of training program materials to suit the LLN needs of a student is based upon the recommendations and comments of the assessor.
The assessor ensures literacy and numeracy is considered by employing:
- Presentations supported by practical application using the physical resources generally available, i.e. those which are practical and tactile.
- Training programs are conducted using short presentations, demonstrations and question and answer formats and
- Written question papers are used in some assessments, but strategies for ensuring other methods of assessment that are not written are employed when LLN is identified as requiring support.
- Language problems of a student may necessitate the use of a one on one scenario, i.e. one trainer to one student, to ensure the student absorbs and understands the material being presented. In some cases, the student may be advised to use an interpreter, the cost of which to be borne by the student.
The information in relation to a student’s LLN skills is recorded on their LL&N assessment upon enrolment which is kept on their file and all information in relation to a student’s LLN skills is strictly confidential.
Evolation Learning has an effective administrative system and a student records management system that complies with all privacy legislation to ensure the financial records of the business and students and staff personal details and information are always kept private and confidential.
The purpose of this policy and procedure is to ensure students and staff personal details and information are kept private and confidential at all times
This policy and procedure applies to all staff of Evolation Learning. Trainer/assessor staff should have a clear understanding of this policy and procedure so that they can ensure student’s privacy always.
Evolation Learning is committed to keeping accurate and confidential records in relation to its clients and the activities conducted on their behalf. Access is provided to participants in the training program to their own personal records.
The computer based records management system has the capacity to provide the registering body with
AVETMISS compliant data. Evolation Learning only releases information on participants to the VET Regulatory Authority (ASQA) and State Education and Training Department as required for its registration compliance and funding agreements.
Only authorised personnel at Evolation can access client records. Authorised personnel will maintain the confidentiality of client records.
During the enrolment process personal details of students are recorded (ie. name and address) on an internal database. All personal and financial details are kept confidential.
No details provided to Evolation Learning are sold or otherwise released to a mailing list or other organisation without the express permission of the individual concerned, in writing. Evolation Learning will safeguard all confidential information provided to them by:
- Not disclosing any personal information on participants to a third party, except with the written consent of the client (This is not a common practice for disclosure of this information).
- Providing access to clients of their own personal records, upon written request.
Access to Personal Records
If a client makes an application to obtain access to their personal records they must do so in writing and provide this written application to Evolation Learning who will ensure the personal records are provided within seven (7) working days from the date of the application.
If a client wishes to allow a third party to access their personal records, they must make an application in writing on Release of Information to a Third Party. The Third Party will be requested to provide photographic identification before the information is released to them. Evolation Learning will provide the information requested within fourteen (14) days from the receipt of the application.
UNIQUE STUDENT IDENTIFIER (USI)
Evolation Learning will meet all its obligations for collecting USI numbers from students for reporting requirements for AVETMISS data under the National VET Provider Collection Data Requirements Policy. Evolation Learning will meet all requirements with the Student Identifier Scheme.
The purpose of this procedure is to enable Evolation Learning’s students and staff to ensure that they understand the procedure and requirements for creating and verifying a USI number as of the 1st January 2015.
This current policy applies to both students and staff of Evolation Learning.
All students enrolled in a qualification with Evolation Learning will need to have a USI before their Statement of Attainment or any other qualification can be issued. Evolation Learning will offer these students an opportunity to have their USI created through our application process once they supply the required identification and have given signed permission for Evolation Learning to apply on their behalf.
Once this process has been completed and a USI number has been generated, USI will either email or text message these students with their USI number and details. Alternatively, students can apply for a USI themselves and provide this to Evolation Learning for verification, however, if it is not received by the time assessment has been marked the issuing of the qualification or statement of attainment will be delayed until it has been provided. This same process also applies to students who enrol after 1 January 2015.
Under the legislation, Evolation Learning cannot issue a statement of attainment or qualification to a student without a verified USI.
Evolation Learning will not disclose the USI number or any information provided to create the USI except where authorised.
Evolation Learning will not display the USI number on any Qualification/Statement of Attainment provided to either the student or employer.
In accordance with Standard 3 Clause 3.5 Evolation Learning supports the national policy for national recognition of VET qualifications and Statements of Attainment issued by other Registered Training Organisations (RTO) regardless of the location if the RTO is registered to offer the qualification.
The purpose of this policy and procedure is to ensure all staff and students at Evolation Learning are aware of the process for national recognition.
The following procedure is to be implemented by all staff within Evolation Learning.
1. Documentation for Students
Evolation Learning will incorporate information on national recognition in its documentation relating to courses. The Student Handbook will ensure participants have information relating to the opportunity for national recognition of units of competency achieved with RTOs registered to deliver the same units of competency. These units of competency may be included in other Training Packages.
2. Dissemination to Staff
As part of the induction and ongoing professional development, staff will be informed about national recognition. This information will also be included in staff meetings as cases arise or circumstances require.
Upon application by a student for national recognition, they must supply the original statement of attainment or Qualification Certificate (or a certified copy) to Evolation Learning. Students completing qualifications or units of competency after 2015 may also provide their validated USI transcript as evidence of completion.
Upon receipt of this documentation, Evolation Learning will validate the documentation and grant credit to the candidate for the unit of competency. This will be recorded on the candidate’s Training Plan.
The student will then be issued with a written result.
ISSUE OF QUALIFICATIONS AND STATEMENTS OF ATTAINMENT
Evolation Learning issues AQF Qualifications and Statements of Attainment to meet the requirements of the current AQF Implementation Handbook and the accredited courses or endorsed Training Packages within its scope of registration.
The purpose of this policy and procedure is to ensure the correct procedures are adhered to in the issuance of Qualifications and Statements of Attainment in accordance with Standard 3 Clause 3.1 – 3.4
This policy covers all staff involved in the administration, training, delivery and assessment of vocational education and training programs within the scope of registration held by Evolation Learning
Evolation Learning will check that the participant has satisfied the assessment requirements in order to be given a result of competent, or not yet competent in the following manner –
For participants who have completed assessments check that the Performance Criteria and required knowledge and skills have been met, as well as all requirements of the Assessment Schedule and Assessment Plan.
For Recognition of Prior Learning, assessments check all evidence Against the Training plan and record units for which there is sufficient, valid, authentic and current evidence.
Update computer files and hard copy files including Training Plan
2. Print and sign the Certificate or Statement of Attainment
- Check the spelling of the person’s name
- Check that the appropriate units of competency are shown
- Check that the date of issue is correct
- Print or email the Certificate or Statement of Attainment if required
- Sign the document – authorised persons only to sign
3. Enter the details in the Qualifications/Statement of Attainment in the AVETMISS system, record the person’s name, award and date of issue in the Register.
4. Prepare the document for mailing or emailing.
Insert the Certificate/Statement into a clear plastic protective pocket. Include a Compliments Slip with a message of congratulations Reinforce the envelope with a cardboard insert to prevent folding. Enter the name, address and date mail in the qualifications register.
5. Issue of Qualifications/Statements Review
Qualifications or Statements of attainment will be visually checked by the CEO or Quality Manager at the time of issue, before signing, to ensure that they meet the current Australian Qualifications Framework Implementation Handbook (can be sourced at www.aqf.edu.au).
6. Certificates issued are reviewed to ensure they are correct and have the following information:
- Name and logo of Evolation Learning
- Name of person receiving the qualification
- Nomenclature as in the Framework
- Date issued
- Authorised signatory
- Nationally Recognised Training (NRT) Logo in accordance with the current conditions of service (can be sourced at www.training.com.au)
- Identifies Evolation Learning by its national provider number from the National Training Information Service
- The words ‘The Qualification certified herein is recognised within the Australian Qualifications Framework’ or the logo is used.
- A record of results will be issued together with the qualification.
With Statements of Attainment check to ensure that they include:
- Name and code of the issuing RTO
- Name of the person who achieved the competencies or modules
- Date issued
- A list of competencies (or modules where no competencies exist) showing their full title and the national code for each unit of competency
- Authorised signatory
The Nationally Recognised Training (NRT) logo
- The State/Territory Training Authority logo (only where use of the logo is directed by State/ Territory Training Authorities, e.g within User Choice contracts)
- The words A Statement of Attainment is issued by a Registered Training Organisation when an individual has completed one or more accredited units
- The words These competencies form part of [code and title of qualification(s)/course(s) (this is optional, where applicable)
- The issuing organisation’s seal/ watermark or corporate identifier.
8. Issue of Statement of Attainments
Evolation Learning’s only issues Statement of Attainments, Certificates and record of results once the student has been assessed and the requirements of the training package have been met and completed. Evolation Learning has the right to ensure that any students outstanding fees are finalised prior to the issue of statements within a timeframe of 30 days
9. Documentation maintenance
Evolation Learning maintains records and registers of qualifications for present and past students and is available to students on request. Evidence of such records are kept electronically, by Evolation Learning for a period of 30 years.
10. Requests for copies or re-issue of Statements of Attainment or Qualifications
In the event of a request or re-issue of a copy of a Statement of Attainment or Qualification Certificate, the student will be charged a fee of $50 to cover administration costs. All printing and postage will also be charged to the applicant.
CESSATION OF ACTIVITIES
In the event that Evolation Learning ceases to operate, Evolation Learning will endeavour to support enrolled students to access a suitable alternative Registered Training Organisation to complete their qualification/short course.
Where Evolation Learning ceases to operate, all past and current students will be sent the notice in writing. This notice will inform students that Evolation Learning is ceasing to operate and provide appropriate contact details to students on how they can access their records and/or certifications after the business ceases. Contact may be an appointment at Evolation Learning for some time after cessation, or Evolation Learning will inform students that all records will be held by ASQA and advise how to contact ASQA for information.
WORKPLACE HEALTH AND SAFETY
Evolation Learning will ensure that risk is identified and managed within the organisation and that health and safety standards are in place within Evolation Learning.
This policy and procedure is to be strictly adhered to by all staff employed by Evolation Learning to meet Evolation Learning obligations.
This policy and procedure covers all staff involved in the delivery, training and assessment of Evolation Learning clients. It also applies to the safety of students as well as the risk identified in meeting the Standards for continuing registration.
1. Workplace health and safety
Evolation Learning will ensure it adheres to workplace health and safety practices at its premises and training locations. Evolation Learning will document any safety incidents that occur on Evolation Learning Accident Injury Report. Appropriate action and reporting will be undertaken according to the incident.
2. Induction Procedures
All clients have access to our Student Handbook prior to the commencement of the training program. This Handbook provides information on Company policies such as Access & Equity, Complaints and Appeals, Recognition of Prior Learning and Refund, national recognition of qualifications or statements of attainment issued by other RTOs, RPL as well as the training program being undertaken. Prior to the commencement of each training program the Student Handbook will be issued and an induction process will be carried out and students will be informed of:
- facilities and services available,
- details of the training program and its duration, session plans, etc.
- any specific requirements for specific training activities and
- any known hazards or risks that have been identified and procedures developed to eliminate them.
3. Personal Safety
Evolation Learning and its contractors will ensure all equipment and materials on the training site are maintained and updated as required.
Evolation Learning will identify the need for adequate insurance cover depending on the level of risk involved and cover for Professional Indemnity. Public Liability will be a requirement of Evolation Learning’s insurance portfolio.
- Evolation Learning and its contractors are dedicated to providing a safe working environment and ensuring all trainers/assessors are aware of relevant safety procedures.
- Prior to the commencement of each training program, a risk assessment will be carried out on the training area to identify any potential hazards or risks. Evolation Learning and its contractors will ensure that all persons carrying out training and assessing are suitably qualified for the task.
- Training in a specific safety procedure will be conducted on an ‘as required’ basis.
- Evolation Learning and its contractors will ensure adequate clothing and equipment is specified and worn, whenever there are risks associated with any activity.
- Alcohol, unauthorised drugs and firearms are expressly prohibited.
- Evolation Learning, its contractor, its trainers and assessors and any person in the training area are to abide by the relevant requirements of Commonwealth and State/Territory legislation as it applies to the training environment. Evolation Learning is to ensure its contractors and personnel are kept informed of relevant legislation requirements.

- The attendance registers or rolls or diaries are sorted according to date, year and program and are archived by Evolation Learning
ADVERTISING AND MARKETING
Evolation Learning is committed to a policy of ethical advertising and marketing of its products and services for training and assessment and any associated activities.
The purpose of this policy and procedure is to ensure that all advertising and marketing that is produced by Evolation Learning is accurate, ethical, and abides by the standards set down by Standard 4 Clause 4.1
This policy and procedure covers all staff involved in the design, development, modification or customisation of any advertising or marketing material produced by Evolation Learning.
As advertising is required by Evolation Learning, the designated staff member will design a draft of an advertisement, ensuring that:
- All qualification titles and codes are accurate and use correct nomenclature
- Only accredited qualifications or units are stated as such
If a recommendation or statements and testimonials from clients or any other person or organisation are used as part of any advertising or marketing material produced by Evolation Learning, Evolation Learning will obtain prior written permission for the use of this material.
Evolation Learning will only advertise or market training programs as AQF qualifications if they are included in Evolation Learning’s current scope of registration.
The conditions for using the NRT logo in marketing material will be adhered to; as clearly defined in the NRT logo specifications which can be sourced at www.asqa.gov.au
Any advertising or marketing material will clearly state those programs it is offering which accredited programs are leading to AQF qualifications and/or Statements of Attainment.
Any advertising or marketing material for training programs that are not nationally recognised or accredited programs leading to AQF qualifications and/or Statements of Attainment will be advertised separately from any other training/assessment services.
Once any advertising or marketing material is produced in draft form by the delegated staff member, the draft will be forwarded to the CEO of Evolation Learning who will duly authorise such material seven (7) days prior to its use
Upon authorisation by the CEO of Evolation Learning, any advertising or marketing material will then be proofread by the designated staff member and trainer/assessor and forwarded to the organisation nominated by The CEO resulting from the three (3) quotations obtained.
The advertising and/or marketing material will then be produced in its engrossed form and forwarded to any media authorised by the CEO for reproduction and dissemination.
A copy of the final draft will be placed on Evolation Learning files, together with the authorisation of the CEO and the successful quotation.
A copy of any advertising and/or marketing material will be placed on Evolation Learning files once this has been produced in its disseminated form.
ACCESS AND EQUITY
Evolation Learning will meet the needs of individuals and the community through the integration of access and equity guidelines and will apply equity principles to ensure equality of opportunity without discrimination in accordance with Standard 5 Clause 5.1 by:
- Our own trainer/assessors at Evolation Learning are able to access support for any student who may require specialist teaching to improve their level of literacy. Liaising with other disability support groups to ensure that other special needs can be catered for in areas where Evolation Learning has no knowledge or experience.
- Ensuring that the training materials and assessment documentation are written at a level that is clear and easily understood.
- Providing support with tutorial assistance for any student who is encountering learning difficulties.
- Meeting legislative requirements
- Satisfying individual student needs
- Enabling student outcomes to be met
- Addressing community needs
- In addition to formal reviews, our policy will be checked whenever there is a change in legislation or we discover there are circumstances not covered by our policy.
This policy and procedures serve to provide guidelines for providing opportunities for all people, regardless of their background. Evolation Learning supports government policy initiatives and provides access opportunities whenever possible, or seeks assistance for students from the relevant Agency or department.
Evolation Learning’s training programs are accessible for anybody who has the interest and desire. Evolation Learning encourages people to reach beyond their limitations and endeavour to remove any obstacles that are within our capabilities. This applies particularly to female students who may be disadvantaged with family commitments, aboriginal students, Torres Strait Islander students, students from non-English speaking backgrounds, students with disabilities, gifted and talented students, geographically isolated students and students from low socioeconomic backgrounds.
This policy and procedure covers all staff involved in the administration, delivery, training and assessment of training programs being delivered to our clients.
Evolation Learning will ensure the establishment of non-discriminatory student selection procedures that encourage fair access for members of under-represented groups.
On enrolment, each student is required to complete a written LL&N assessment. Upon assessing a student for any support required for language, literacy, numeracy or other barriers to learning, Evolation Learning will provide opportunities for people with language/literacy barriers by:
- providing tutorials for people who have learning difficulties – these are any student having difficulty understanding or interpreting information.
- establishing liaison with organisations and government departments that are responsible for assisting and supporting people with barriers to learning – e.g. Commonwealth Rehabilitation Service – where there is a need for specialised support because of work injury or work-related health problems. These are confidential.
3. Procedure when Client attends our Training Programs
On identification of disability/learning barriers on enrolment or throughout training by Evolation Learning clients will be assessed and supported by:
- assessment completed by each student on enrolment. Each assessment is individually checked by our trainer/assessors who all hold a current LL&N
- individual support to improve capacity to meet criteria. For example if a student struggles with language we provide an audio version of the document that the student is required to study
- maintaining confidentiality
4. Procedure for Referrals from Outside Agencies or Organisations Upon referral from an outside Agency or organisation, Evolation Learning will:
- determine nature of the problem where possible and identify needs
- respond to individual/organisations needs where able – flexibility is often required to meet special needs e.g. rehabilitation clients or those referred by medical practitioners
- provide flexible access, tutorial support, individual tuition as required
- report back to support agency/organisation where required –
- liaise with representative throughout training
5. Review of Access and Equity Policy and Procedures
Evolation Learning will review policy and procedures to ensure they are meeting legislative and regulatory requirements, as well as operating effectively and will monitor changes in legislation and regulations to ensure that any new requirements are catered for.
Evolation Learning will also document any recommendations for change and record when these changes are implemented – based on our own experience or those of other organisations, through personal contact, through others, or media.
Students have the right, to submit any complaints or appeals to Evolation Learning on academic decisions, procedural matters or any issues that directly relate to the successful completion of their course.
Evolation Learning supports the student’s right to lodge any complaint or appeal, and will not restrict that right in any way. Evolation Learning will do everything possible to address any complaint or appeal in an unbiased, professional manner.
This Policy is designed to encourage confidential resolution of complaints and appeals with a minimum of delay and formality for any student who believes that she or he has been unfairly treated and has an issue with Evolation Learning.
The purpose of this policy and procedure is to ensure that complaints and appeals are resolved appropriately in accordance with Standard 6 Clauses 6.1, 6.2, 6.3, 6.4, 6.5, 6.6
This policy and procedure applies to all staff of Evolation Learning. Trainer/assessor staff in particular should have a clear understanding of this policy and procedure so that they can ensure students are aware of this process.
Complaints and appeals may include, but are not limited to, academic matters, discrimination, complaints related to access and conditions, and complaints related to training/assessment or support services or provision of Company facilities.
A student who is dissatisfied with any academic decisions, or procedural issues should submit in writing their complaint or appeal to the CEO within twenty eight (28) days of the issue or the assessment. The address where complaints and appeals can be submitted is to The CEO-Evolation Learning Pty Ltd, 10 Margot Court, Harlaxton. 4350.
A complaints form can be obtained from the CEO by email request.
The CEO will investigate within ten (10) days, assess the situation and take appropriate action to resolve the situation. The complaint will be recorded on the Complaints and Appeals Register, and a copy of the complaint or appeal will be filed together with the register.
If the complaint is related to instruction or assessment, the CEO will arrange a meeting with the trainer/assessor and the student to discuss the issue.
Complaints relating to fellow students will be handled in the same way, with a meeting between the student involved and the CEO.
If any complaint or appeal is not resolved in the above manner, the person making the complaint or appeal should document their issue in writing to the CEO.
In the event of a complaint or appeal against Evolation Learning, staff or fellow student involving an alleged breach of civil law, the student should contact the CEO, and if not resolved, should be referred to the appropriate authority, government department or independent arbiter.
In the event of a complaint or appeal against Evolation Learning, either party or both parties can access the National Complaints Hotline (1800 00 674) for further support. If a student requires further support, or should an outcome not be acceptable by the student, all complaints or appeals can be lodged through ASQA (Australian Skills Quality Authority) – 595 Collins St, Melbourne VIC 3000 (1300 701 801).
Should the person making the complaint or appeal not be satisfied with the decision, a process for resolution will be undertaken by the student and Evolation Learning.
In the case of the use of an independent arbiter, the agreement is to be reached between Evolation Learning and the relevant student regarding the external consultant to be engaged for use in the external appeal process. Consultants engaged to conduct the appeal process are to hold recognised qualifications that meet the human resource requirements for the relevant course.
Where a student wishes to use an external consultant, who is not approved by Evolation Learning the student is responsible for the payment of all costs associated with the use of the external consultant in the appeal process.
Upon resolution of the issue, the outcome of the complaint or appeal stating the reasons for the decision will be provided in writing to the person making the complaint or appeal. A copy of the appeal or complaint, together with a copy of the outcome supplied will be kept in Evolation Learning’s records.
Where the RTO considers more than 60 calendar days are required to process and finalise the complaint or appeal, the RTO informs the complainant or appellant in writing, including reasons why more than 60 calendar days are required, and regularly update the complainant or appellant on the progress of the matter.
An appeals and reassessment process is an integral part of all training and assessment pathways leading to a nationally recognised qualification or Statement of Attainment under the Australian Recognition Framework.
All ongoing or completed complaints and appeals are securely stored in a secure drive which is only accessible by authorized personnel.
Once a complaint or appeal has been finalised, all results and corrective action taken is recorded in the Complaints and Appeals Register.
STUDENTS WISHING TO COMPLETE A COURSE WITH EVOLATION LEARNING WHILST ON A VISA
Evolation Learning is not registered with the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS).
Any student who is wishing to study with Evolation Learning and holds a visa is encouraged to make contact with Evolation Learning to ensure that all requirements can be met. There can be limitations on students who hold certain visas with studying with Evolation Learning.
Often, most visa’s will not impact a student’s ability to Study with Evolation Learning however there are some categories of Visa’s that may impact a student ability to complete the course. Particularly, students who hold “Student Visa’s” wishing to use the course they wish to complete with Evolation Learning to maintain or gain the visa; cannot use the course to meet these criteria as we are not CRICOS registered.
It is important to note that the student has the responsibility to ensure that they comply with their visa conditions and requirements, and this is not the responsibility of Evolation Learning.
Any student who holds a Visa is required to notify Evolation Learning to ensure that appropriate checks can be conducted to ensure that the course of study will assist the student and will meet the student’s needs.
PLAGIARISM AND CHEATING
Plagiarism is presenting someone else’s work or ideas as your own, with or without their consent, by incorporating it into your work without full acknowledgement.
Some examples are submitting someone else’s work by copying or by substantially using another person’s answers as your own, or someone else completing the assessment tasks for you. This policy also covers the issue of cheating, that is the falsifying of assessment records. This includes all assessment tasks including observation forms and supervisor declarations.
- If evidence of plagiarism or cheating is identified, you will be contacted and advised of the concerns with your submitted work and you will have an opportunity to respond to the concerns raised.
- If it is established that you have engaged in cheating you will either be given a formal warning and asked to resubmit or, if deemed sufficiently serious, your enrolment will be terminated, for which all fees paid are forfeit and non-refundable.
The CEO/Manager of Evolation has the final say on the outcome and has the final determination on the level of seriousness.
